In June 1980, the CRE received information from a white employee at Westminster City Council that no black people were employed as dustmen in the northern area of the Council's Cleansing Department. By contrast, a considerable number of the road sweepers in that area were black. Black people were employed as both dustmen and sweepers in the southern area. The informant alleged that this discrepancy was the result of
discrimination in the appointment of dustmen by the Council,
brought about by pressure on the Council's management from the
local branch of the National Union of Public Employees (NUPE).
On the basis of this information the CRE decided in August 1980 to conduct formal investigations under Section 49(4) of the Race Relations Act 1976 into suspected direct or indirect discrimination in the appointment of refuse
collection staff at Westminster City Council's North Wharf Road
Depot, NUPE and four officers of the Westminster No 2 branch of the
Union.
